Xpand Telemarketing welcomes the new GDPR legislation which came into effect on the 25th May 2018. This legislation allows us to market on your behalf professionally. The key to the compliance is being able to record, log and retain privacy details of the people you are marketing to. But first let’s look at the specific part of the GDPR legislation that allows us to continue to market your products and services.
Article 6 EU GDPR “Lawfulness of processing”
1. Processing shall be lawful only if and to the extent that at least one of the following applies
(a) the data subject has given consent to the processing of his or her personal data for one or more specific purposes;
(b) processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;
(c) processing is necessary for compliance with a legal obligation to which the controller is subject;
(d) processing is necessary in order to protect the vital interests of the data subject or of another natural person;
(e) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
(f) processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.
Article 6 clause f allows us to “cold call” on your behalf if Legitimate business interest can be proved (assuming the data on the list we are going to call from have not explicitly asked us to not them by telephone). Please contact us to find out more.

How we manage your GDPR telemarketing obligations.
Xpand Telemarketing use a bespoke telemarketing CRM platform which allows us to manage all your GDPR obligations. Our CRM allows us to record, log and retain privacy details of your legitimate business interest targets. Assuming we can prove the intended target will have a legitimate business interest for your product, we mark all the list with the following status: Legitimate interest (we vet all lists with you to make sure we remove any non-viable targets).
If the intended target once contacted is found to be a non-viable prospect, we simply withdraw that target from your database and record, log and retain this information in compliance with GDPR legislation.
All withdrawn contacts are held in a withdrawn area of your database within our CRM. This allows us to suppress against any further data introduced to your campaign in compliance with GDPR legislation.
